Terms & Conditions of Supply

The 3 Trade-ins service is operated by Revive Mobile Limited. Revive Mobile may contact you directly on behalf of 3 in relation to your trade-in.

Please read these terms and conditions carefully before posting your handset(s). You should understand that by posting your handset(s) you agree to be bound by these terms and conditions. Please understand that if you refuse to accept these terms and conditions, you will not be able to proceed with the trade-in. You should keep a copy of these terms and conditions for future reference.

Definitions

For the purpose of these conditions:

'3' means Hutchison 3G UK Limited, a company incorporated and registered in England and Wales (company number 3885486) - address: PO Box 333, Glasgow, G2 9AG;

'you', 'your' means you - a person or entity who wishes to use, uses or has used the trade-in scheme offered via 3's own website, 3 retail stores or 3 customer services to trade-in a handset;

'we', 'our', 'us' means 3's authorised service provider, Revive Mobile Limited, a company incorporated and registered in England and Wales with company number 05855236, whose registered office is at Unit 1, Colne Way Court, Colne Way, Watford, Hertfordshire, WD24 7NE;

'Customer data' means the data supplied by you, or by 3, its authorised users and/or by us for the sole purpose of providing this trade-in service to you.

How The Contract Is Formed Between You And Us

Your contract with us will be formed when you send your handset(s) to us. It will incorporate these terms and conditions.

You must own all rights, title and interests in any handset(s) that you send to us and you agree that you will pass ownership of the handset(s) to us as part of this trade-in service in return for payment by us of the trade-in sum.

Ownership of the handset(s) will only pass to us when we receive the handset(s) and verify that the handset(s):

are in the condition described by you; and

have not been reported stolen through the CheckMEND system; and

are in accordance with these terms and conditions; and

we have dispatched payment to you.

The contract between you and us is binding on you and us and on our respective successors and assigns.

You may not transfer, assign, charge or otherwise dispose of a contract, or any of your rights or obligations arising under it, without our prior written consent.

We may transfer, assign, charge, sub-contract or otherwise dispose of a contract, or any of our rights or obligations arising under it, at any time during the term of the contract.

You may only cancel this contract by notifying us in writing.

This contract cannot be cancelled once our payment has been issued to you.

PLEASE ENSURE THAT YOU ARE HAPPY TO SEND THE HANDSET TO US AND THAT IT IS WITHIN YOUR RIGHTS TO DO SO.

Customers' Obligations

By posting your handset(s) to us, you agree that:

You are resident in Great Britain or Northern Ireland; and

You are legally capable of entering into a binding contract; and

You are at least 18 years old; or

If you are under 18 years of age, that you have obtained your parent's or guardian's consent to sell your handset(s) to us for the sum indicated in our letter (order confirmation).

You and your parents or guardians release us or 3 of any liabilities or claims that may arise if you send the handset to us in breach of this warranty.

If you deal as a consumer, any provision of this contract which is of no effect to a consumer shall not apply. Your statutory rights are not affected by this contract.

For the purposes of these terms and conditions, "consumer" means an individual who neither makes this contract in the course of a business, nor holds himself or herself out as doing so, as defined by the Unfair Contract Terms Act 1977.

You acknowledge and agree that your use of this service is in no way directly linked to any other commercial activity or promotion operated by 3 or us.

Customer Data

You understand and agree that all data provided by you in the course of using this trade-in service will be received and processed by 3 or by us solely for the purposes of providing this service and will not be used for any other commercial or marketing activities by us.

All customer data will be processed strictly in accordance with the Privacy and Data Protection policies of Revive or 3, copies of which can be provided on request.

Handsets

Each handset traded-in should match the make and model in the sale order and meet the following conditions:

Working

The handset must turn on and off

The handset must be fully functional

The screen must be working and intact

The battery must be included

The handset must not be crushed or water-damaged

Non-Working

The battery must be included

The handset must not be crushed or broken in half

By submitting a trade-in order you warrant that the handset(s) comply with these terms.

If a handset fails to meet our terms and conditions we'll propose an adjusted price to you by email. If you choose to decline our new offer, we are happy to return the handset. A delivery charge will be applicable. We have the final decision on all handset values.

In the event that you choose to cancel the contract for any other reason prior to our payment being issued to you, we will again be happy to return the handset to you, though an administration charge and a return delivery charge may be applicable.

Please note:

We accept handset battery chargers and accessories but will not make payment for these items, regardless of condition make or model.

You are responsible for cancelling any handset or airtime contract linked to each handset. We are not responsible for any call or other costs arising before, or after, receipt of your handset(s), or arising from any other circumstances whatsoever.

Please remove SIM cards before sending us your handset. Any SIM cards received by us will be destroyed, and so obviously cannot be returned nor any refund made. (We will dispose of them appropriately.) We accept no liability in the event that any handset that has been sent with its SIM card is lost and charges are then incurred. You shall continue to be responsible for such charges.

Please remember that by sending your handset(s) to us, you agree to release us and 3 from all and any claims, losses or damages with respect to the handset(s), any SIM card, any data stored or contained therein or on any media used in conjunction with the handset (whether in the form of personal details, SMS, photos, games, songs or other data). We accept no responsibility in relation to the security, protection, confidentiality or use of such data and it is your responsibility to ensure that such data is removed from the handset(s) prior to you sending it to us.

We work with 'Immobilise', a crime protection database that blocks stolen mobile phone handsets and so we check received units via CheckMEND to ensure that the handsets that are sent to us are not reported stolen. We do this prior to confirming purchase. However, in the event that we become aware of any issues with your handset(s) at any time, we reserve the right to withhold/cancel payment and you agree to co-operate with us and any authorities should we so request.

Pricing

When your order has been placed, the prices quoted are guaranteed for 14 days from the 'Order Approved' date. (This is the date on which we send you a confirmation letter and Freepost bag.) If your handsets are received after 14 days from the 'Order Approved' date, the up-dated, current prices will apply to your hand-set trade-in. This up-dated price may be less than the price originally quoted to you - so to help you, we'll send a reminder email during the 14 day guarantee period.

Postage

We pay for postage of your handset to us. Just use the Freepost Revive bag provided. Unfortunately, we do not accept responsibility for non-delivery of handsets or damage in transit. We therefore recommend that you send any high value units via registered post at your own expense to ensure successful delivery.

Payments

When we receive your order, we will check that it is complete, and that it meets our terms and conditions. Providing it does, we will send payment to you, by cheque, within 7 days or as soon as possible after that. Please Note: Payment can only be made to the name and address given when you trade-in your handset(s) in store, online or via the telephone.

Events Outside Of Our Control

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by events outside our reasonable control or due to our compliance with any applicable laws or regulations.
